HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 9080 OF 2012 ORDER:
The present Writ Petition came to be filed seeking to declare the action of respondent Nos.3 to 5 in getting the Lok Adalath award in LAC No.1890 of 2011, dated 29.09.2011, before the Lok Adalath, Vijayawada, in favour of respondent No.4 by respondent No.3 herein with reference to valuable landed property including the buildings covered admeasuring Acs.5.10 cents in NTS No.13, Mogalrajapuram, Vijayawada belonging to M/s.Durga Malleswara Educational Society, by fraudulently, without any authority or interest over the said property as illegal and arbitrary by consequently setting aside the Lok Adalath Award No.1890 of 2011, dated 29.09.2011.
The facts in issue would show that pursuant to the compromise alleged to have been entered into between respondent Nos.3 and 4, the Lok Adalath passed an award dated 29.09.2011 in L.A.No.1890 of 2011, wherein, the terms of compromise have been accepted. Challenging the same, W.P.No.27867 of 2011 came to be filed before this Court. By an order dated 17.02.2012, a Bench of this Court dismissed the Writ Petition holding that when the award of the Lok Adalat has been acted upon, this Court must decline to exercise discretion in favour of the petitioner and hence the award of Lok Adalath is unassailable.
In view of the orders passed by this Court in W.P.No.27867 of 2011, no further orders need be passed in the present Writ Petition.
Accordingly, the Writ Petition is closed. No costs. Consequently, the Miscellaneous Petitions, if any, pending in this Writ Petition shall also stand closed.
