HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 22662 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties. The petitioner was appointed as a fair price shop dealer of shop No.27, Mandepudi Village, Amaravathi Mandal, Guntur District. His authorization is valid upto 31.03.2016. While so, the Civil Supplies Deputy Tahsildar, Pedakurapadu inspected the shop of the petitioner and found some variation in stock. Based on the report of the Civil Supplies Deputy Tahsildar, Pedakurapadu, a show cause notice was issued to the petitioner on 13.02.2015. The petitioner submitted his explanation on 13.04.2015. After considering the explanation, the third respondent passed an order on 24.04.2015 cancelling the authorization of the petitioner.

Against the same, the petitioner preferred an appeal, along with stay petition, to the second respondent on 18.05.2015. As the second respondent has neither disposed of the stay petition nor the appeal, the petitioner filed the present Writ Petition. In view of pendency of appeal before the second respondent against the order of the third respondent dated 24.04.2015, this Court is not inclined to go into the merits of the case. The second respondent shall consider the stay petition, filed along with the appeal, and dispose of the same within a period of seven days from the date of receipt of a copy of this order.
