THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8147 OF 2016 ORDER:
This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/A.4 seeking bail in S.C.No.60 of 2014 on the file of the Special Judge for Protection of Children from Sexual Offences Act-cum-Additional Metropolitan Sessions Judge, Vijayawada, arising out of offences under Sections 376, 376-D, 384, 354-A(ii), 354-D(i), 506 and 509 read with Section 34 IPC and Sections 4, 6 and 12 of the Protection of Children from Sexual Offences Act, 2012.
Heard and perused.
Learned counsel for the petitioner submits that the earlier bail application is dismissed by this Court on 16.02.2016, wherein a direction was given to the Court below to complete the trial as expeditiously as possible, preferably within a period of three months. He further submits that the Court below has not completed the trial till now and as such, prays this Court to grant bail to the petitioner. Learned Additional Public Prosecutor submits that almost all the witnesses are examined and the matter is posted for cross-examination of the Investigating Officer. He further submits that even if the Court below does not complete the trial in the time stipulated by this Court, the petitioner is not entitled for bail.
Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. The Criminal Petition is accordingly dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 20.06.2016 pln
