THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.35989 of 2015

ORDER :

The petitioner was appointed as Field Assistant of Balijapalem Village, Kandukuru Mandal, Prakasam District in December 2012. While so, by proceedings dated 01.07.2014 on various allegations, petitioner was removed from the post of Field Assistant. Aggrieved thereby petitioner filed appeal before the Commissioner, Panchayat Raj & Rural Development Department, on 14.07.2015 and the same is pending consideration. Aggrieved by the inaction on the part of the appellate authority in passing orders in the appeal, this writ petition is filed.

2. Having regard to the fact that petitioner filed appeal against the order of removal from service, and the said appeal is pending consideration of the authority, I am not inclined to express any opinion on merits and the Writ Petition is disposed of directing the Commissioner, Mahatma Gandhi National Rural Employment Guarantee Scheme, Hermitage Building, Saifabad, Hyderabad (2nd respondent) to consider the appeal and pass appropriate orders as expeditiously as possible preferably within a period of eight (8) weeks, from the date of receipt of copy of this order and communicate the decision to the petitioner as warranted by law. There shall be no order as to costs.
