HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2117 of 2015 ORDER:

This Criminal Revision Case is filed by the petitioners - Accused Nos.2 to 5 under Sections 397 and 401 of Criminal Procedure Code challenging the order, dated 13.07.2015, passed in Crl.M.P. No.48 of 2014 in SC No.24 of 2013 by the Metropolitan Sessions Judge, Cyberabad at L.B. Nagar, wherein the learned Sessions Judge dismissed the application filed by the petitioners to discharge them from the offences punishable under Sections 37(a) of A.P. Excise Act and 8(c) r/w.22(b) of the NDPS Act.

Heard and perused the material available on record. The petitioners are the Accused 2 to 5 in the above Sessions Case. They filed an application before the trial Court to discharge them from the above SC. The learned Sessions Judge dismissed the said application through the order impugned. When the matter is taken up for hearing, learned counsel for the petitioners submitted that he is not pressing the revision case and the revision can be dismissed as not pressed and requested this Court to dispense with the presence of the petitioners before the trial Court.

Considering the facts and circumstances of the case and also taking into consideration the request made by the learned counsel for the petitioners, the presence of the petitioners - A2 to A5 is dispensed with before the trial Court except on the dates on which the trial Court is insisted for their presence. Accordingly, the Criminal Revision Case is dismissed as not pressed. Miscellaneous petitions, pending if any, shall stand closed. ______________ RAJA ELANGO, J December 02, 2015 KTL
