HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 35940 of 2018 ORDER:

1) Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondents in trying to dispossess the petitioners from the agricultural lands admeasuring Ac.1.74 cents covered in Survey No.502/4 of Yallamanchili, Yallamanchili Mandal, Visakhapatnam District, at the instance of respondent Nos. 8 to 10, as illegal and arbitrary.

3) Though various grounds are raised, learned counsel for the petitioners would submit that any interference by the respondents can only be in accordance with law. 4) It is his case that since the unofficial respondents failed to get any orders from the Civil Court in their favour, they are resorting to this method of evicting the petitioners. 5) Learned Government Pleader for revenue, who took time to get instructions, would submit that there is a land dispute between the petitioners and the unofficial respondents before the Senior Civil Judge, Yelamanchili, vide O.S.No.52 of 2017. He denies the alleged interference by the official respondents in respect of the subject property.

6) Having regard to the submission made by the learned Government Pleader for revenue, with regard to non- involvement of the official respondents in respect of the subject property, the writ petition is closed. 7) It is needless to mention that any interference by the official respondents shall only be in accordance with the procedure established by law.
