HONOURABLE SRI JUSTICE N. BALAYOGI CRIMINAL PETITION No.9028 of 2011 ORDER:

This petition is filed by the petitioners-accused Nos.3 & 4 under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.114 of 2007 on the file of the Judicial First Class Magistrate-cumJunior Civil Judge, Parachoor, Prakasham District. 2.
Heard the learned Counsel for the petitioners. After hearing the learned Counsel for the petitioners, the learned Public prosecutor stated that the bundle is not available. There is no representation on behalf of the 1st respondent. Since the matter is listed under the caption of "for dismissal", the orders are pronounced.

The contention of the petitioners is that the complainant is doing business in non-trading Rice Mill and that the 1st petitioner has no role in selecting, printing and publishing news item and that the 2nd petitioner has no grouse against the complainant and that the news item was reported and published as per the information available to the reporter through Tirumalasetti Venkateswarlu and the members of consumer society and food committee.

A perusal of the record goes to suggest that there was a news item on 11.6.2006 in the District Edition of Vaartha and Eenadu Daily News papers to the effect that the complainant is illegally doing gas business and is selling gas at higher rates in black market and that he is acting as a private agent and in spite of several complaints, neither the civil supplies authorities nor Indian Gas authorities are taking any action against him.

The 1st petitioner is the Managing Director and the 2nd petitioner is Editor of Vaartha Telugu Daily News paper. The investigation was completed and charge sheet was filed and it was numbered as C.C.No.114 of 2007. All the defences taken by the petitioners herein can be adjudicated after trial. I do not find any reason to quash the proceedings in the above C.C.

Accordingly, the Criminal Petition is dismissed. Consequently, interim stay granted on 28.9.2011 in Crl.M.P.No.9851 of 2011 is vacated and miscellaneous petitions pending, if any, shall stand closed. _____________________ JUSTICE N. BALAYOGI Date: 11th October, 2017 Nn
