Heard the learned Counsel for the petitioner and the learned Government Pleader for Home appearing for respondent Nos.1, 2, 4 and 5 and the learned Counsel for respondent No.3. This Writ Petition is filed challenging the action of respondent No.2 in registering FIR No.296 of 2016 against the petitioner on 18.12.2016 for the offences punishable under Sections 417, 420, 376 and 313 IPC on a complaint made by respondent No.3.

Having carefully perused the complaint of respondent No.3, this Court is of the view that the allegations made therein need investigation and since the complaint discloses a prima facie case for registration of crime, this Court is not inclined to interfere with the same. However, the petitioner need not be arrested for investigation of the crime.

On 26-12-2016, this Court has passed an interim order directing the respondents not to arrest the petitioner. The said order is now modified by permitting respondent No.2 to continue with the investigation pursuant to registration of the crime but

ARLR, J WP.No.45301 of 2016 Dt: 27.03.2017 without arresting the petitioner. In case of necessity, he shall obtain appropriate orders from the Magistrate concerned. Subject to the above direction and observation, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, WVMP.No.784 of 2017 in/& WPMP.No.55847 of 2016 are disposed of. _______________________ (A.Ramalingeswara Rao, J) Dt: 27th March, 2017 lur
