THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.35801 of 2018 ORDER:

When the matter is taken up, written instructions, dated 04.10.2018, furnished by the Sub Inspector of Police, Sultanabad Police Station, Peddapally District, are placed on record by the learned Government Pleader.

The said instructions, to the extent of their relevance to the present Writ Petition, read as under:

"It is respectfully submitted that on receipt of communication about the filing of the present writ petition by the petitioner herein, this respondent has thoroughly verified the records of this respondent police station including the Station General Diary as to whether any complaint or case has been received or registered against the petitioner herein on the file of Sultanabad Police Station, Peddapally District. As of now, no complaint or case whatsoever was received or registered against the petitioner herein on the file Sultabanad Police Station, Peddapally District. It is humbly submitted that this respondent never summoned the petitioner to the police station at the instance of the 5th respondent or ask him to settle the matter as per the terms of the 5th respondent as alleged.

It is humbly submitted that as a precautionary measure to prevent the police from taking any action in the event of lodging of any complaint by the 5th respondent in future, the petitioners rushed to this Hon'ble Court and filed the present writ petition with false and untenable allegations. It is pertinent to submit that this respondent is not the competent authority to dispossess the petitioner from the subject lands in question.

I humbly submit that the dispute of the petitioner herein as well as the 5th respondent herein is purely civil in nature. To settle his personal scores with the 5th respondent, the petitioner made false and baseless allegations against this respondent.

1 humbly submit that this respondent never interfered with the peaceful possession and enjoyment of the properties of the petitioner herein".

By placing on record the above written instructions, Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
