- 2 - THE HONOURABLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.2614 of 2018 ORDER :

WP.No.3635 of 2016 filed by petitioner was disposed of by order dated 08-02-2016. Duly taking note of the legal notice issued on behalf of petitioner dated 11-09-2015 direction was issued to the Regional Manager of respondent-Corporation to consider the notice and pass orders. Alleging that the orders of the Court are not complied, this contempt case is filed.

02. On 05-11-2018, Regional Manager passed orders holding that petitioner deemed to have been retired from service on 30-04-2016. Further informing him that since he was unauthorizedly absent from 07-07-2008 to 30-04-2016, he was treated as not on duty.

03. In the Counter affidavit, respondent explained that he took charge of the post of Regional Manager on 02-05-2018 and that he came to know about passing of orders of the Court after notice was received in contempt case and immediately steps were taken to pass orders as directed by the Court.

04. This Court has not fixed any time limit to pass orders. However, within reasonable time, competent authority has to pass orders as directed by the Court. According to averments in the counter, deponent was posted as Regional Manager only in May, 2018 and within short time thereafter he passed orders. Thus, insofar as respondent is concerned, it cannot be said that there was inordinate delay by him in taking decision. However,

- 3 - respondent also offered unconditional apology. The apology is accepted.

Accordingly, the Contempt Case is closed. However, it is open for the petitioner to avail appropriate remedy as available under law, if so advised against decision of Regional Manager, dated 05-11-2018. Pending miscellaneous applications shall stand closed.
