THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.10621 of 2018 ORDER:

This Criminal Petition, under Section 482 Cr.P.C., is filed challenging the direction issued by I Additional District and Sessions Judge, Karimnagar District, for furnishing cash security of Rs.50,000/ - while Ordering interim custody of Maruthi Swift Car Bearing No. AP 28 DA 8777 to the petitioner while exercising power under Section 421 Cr.P.C. during pendency of the trial or enquiry, on the ground that the condition is onerous condition and the petitioner is not in a position to comply such direction being the owner of the above Car. Heard the learned counsel for the petitioner. Taking into consideration the facts and circumstances of the case, the condition imposed by the I Additional District and Sessions Judge, Karimnagar, is modified as follows:

" Return the Maruthi Swift Car bearing No.AP 28 DA 8777 to the petitioner/ accused No.2/ owner of the vehicle on executing a personal bond for a sum of Rs.3,00,000/ - ( Rupees Three Lakhs only) with one surety for likesum to the satisfaction of I Additional District and Sessions Judge, Karimnagar besides he shall produce cash security of Rs.25,000/ - (Twenty Five Thousand) by way of FDR in any nationalized bank. The petitioner shall not alienate the vehicle or change the colour of the property and he shall not create any third party interest over the said vehicle and the petitioner is further directed to produce the vehicle as and when directed to do so". With the above direction, this Criminal Petition is disposed of.

Miscellaneous Petition, if any pending, in this case, shall stand closed.
