THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.11420 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue an order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents herein in not granting special grade and advancement increments on completion of 12 years and 20 years of service by counting the continuity of service from the date of initial appointment including the service rendered in Adilabad Region as per the Circular No.PD30/2005, dated 04.06.2005 and PD No.4 of 2011 dated 12.01.2011 is illegal, arbitrary and contrary to law and the same is liable to be set aside by this Hon'ble Court with all consequential benefits including granting of special grade and advancement increments after completion of 12 years and 20 years (i.e. in the year 2005 and 2013) from the date of initial appointment with all consequential benefits including re-fixation of pay, payment of arrears and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

2. The petitioner entered into service of the respondent Corporation as a driver. He is aggrieved by the inaction on the part of the respondent Corporation in allowing the petitioner, 12 years and 20 years special grade increment though he is entitled as per the Circular bearing No. PD-30/2005, dated 04.06.2005 and PD No.4 of 2011 dated 12.01.2011, issued by the respondent Corporation.

3. Heard learned counsel for the petitioner and Sri.A.Ravi Babu, learned counsel for the respondent Corporation.

4. It is brought to the notice of this Court that the issue raised in this

writ petition is squarely covered by orders of this Court in WP.No.7355 of 2012, dated 21.03.2012 and WP.No.23783 of 2012, dated 28.09.2012.

5. Following the same, this writ petition is allowed directing the respondent-Corporation to consider the petitioner's case for granting special grade increment on completion of 12 years and 20 years of service by considering his total service in the Corporation irrespective of the regions and pass appropriate orders within a period of eight weeks from the date of the receipt of a copy of the order.

5. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 07.04.2016 tk
