THE HON'BLE SRI JUSTICE DILIP B.BHOSALE AND THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No.1982 OF 2014 P.C: (per Hon'ble Sri Justice Dilip B.Bhosale) The petitioners, in the Contempt Case, have alleged a willful disobedience of the directions issued by this Court vide order dated 08.08.2014 in W.A.Nos.1795 of 2013 and 1135 of 2014. The relevant directions read thus: "a) the respondent shall be under obligation to take into account, the entire service rendered by the petitioners from the inception, from the point of view of extending the benefit under G.O.Ms.No.212; b.

such of the petitioners, who qualify under G.O.Ms.No.212, shall be forthwith taken into service, but they shall not be entitled to be paid back wages on account of regularization; and c.

such of the petitioners, who do not fall within the purview of G.O.Ms.No.212, shall be reengaged under Section 25-H of the Industrial Disputes Act as and when work exists in the respondent organization, or extended other benefits, such as retrospective regularization."

Mr. A. Sanjeev Kumar, learned counsel appearing for the respondents, submits that on 19.11.2014 itself the claim of the petitioners has been rejected, since they did not fulfill the conditions prescribed in G.O.Ms.No.212, dated 25.11.1993. Mr. G. Vidya Sagar, learned Senior Counsel appearing for the petitioners, submits that though the petitioners claim has been rejected, it is not clear whey they state that the petitioners did not fulfill the conditions prescribed in the said G.O. Learned counsel appearing for the respondents submits that the respondents would

furnish the reasons to the petitioners within a period of three weeks from today. His statement is recorded and accepted.

In view thereof, in our opinion, nothing further survives in the Contempt Case. The Contempt Case is accordingly closed. This, however, shall not preclude the petitioners from taking appropriate remedy, if any, against the order dated 19.11.2014.

Consequently, miscellaneous applications filed in the Contempt Case also stand disposed of. No costs.
