THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.39306 OF 2013 ORDER:
The case of the petitioner is that he is a practicing advocate at Nirmal having enrolled in the year 1968. He has been practicing in both the civil and criminal sides for more than 45 years at the bar. He also worked as a Standing Counsel for the local municipality and other public sector undertakings. While so, the second respondent requested the first respondent to accord permission for appointment of legal advisors on contract basis on payment of an honorarium of Rs.7,000/- per month. The first respondent issued G.O.Rt.No.1284 dated 18.08.2004 sanctioning appointment of legal advisors in 25 districts on contract basis. Following the said order, the Director General of Police issued proceedings dated 04.09.2004 permitting the second respondent to make appointment of senior advocates as fulltime legal advisors on tenure basis.
The selection is to be made on the basis of panel of suitable practicing advocates or retired P.P.Os. Vide proceedings dated 30.08.2005, the second respondent appointed the petitioner as legal advisor on contract basis on a monthly honorarium of Rs.7,000/- per month. The petitioner assumed charge and performed the duties and continued as such till his services were withdrawn w.e.f. 18.06.2011. Having availed his services till the date of withdrawal, it is the duty of the respondents to ensure payment of remuneration to the petitioner. Aggrieved by the inaction of the respondents in payment of remuneration, this Writ Petition is filed.
Heard Sri V. Ravinder Rao, learned Senior Counsel, who submitted that even though the petitioner rendered services as legal advisor during the period 07.07.2008 till 07.07.2011, his remuneration was not paid, which is arbitrary and illegal. On the other hand, learned Assistant Government Pleader for Home produced proceedings in C.No.4897/A2/2004-2019 dated 14.06.2019 addressed by the Superintendent of Police, Adilabad to the Director General of Police, Telangana State, Hyderabad, wherein the Superintendent of Police requested for allotment of Rs.2,47,618/- towards payment of remuneration to the legal advisor @ Rs.7,000/- per month for the period from 07.07.2008 to 07.07.2011.
Since the respondents have taken steps to pay the remuneration to the petitioner and as the Superintendent of Police has already addressed a letter to the Director General of Police, Telangana State in this regard, the Writ Petition is disposed of directing the Director General of Police, Telangana State, to consider the proposal and take action for payment of remuneration to the petitioner, as per the proceedings dated 14.06.2019, within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no orders as to costs. Miscellaneous applications, if any, pending shall stand closed. ______________________________ (A.RAJASHEKER REDDY, J) 17th June 2019 RRB
