HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.177 of 2016 ORDER:
This petition is filed to withdraw H.M.O.P.No.101 of 2015 from Senior Civil Judge, Gudiwada, Krishna District, and transfer the same to Senior Civil Judge, Ramachandrapuram, East Godavari District.
2. Wife filed this petition. According to her affidavit, her marriage with respondent was solemnized on 10.04.2014 at Gudiwada as per Hindu rites and custom and the marriage was consummated and she became pregnant but her pregnancy is terminated because of abortion. She stated that because of the attitude of respondent and his family members she was forced to stay with her parents at her village and respondent filed H.M.O.P.No.101 of 2015 before Senior Civil Judge, Gudiwada, which is 200 km. away from her village. She further stated that she filed M.C.No.38 of 2015 before Additional Judicial First Class Magistrate, Alamuru, claiming maintenance and she is completely dependent on the mercy of her mother and there were none to help her or to accompany her from her village to Gudiwada to defend H.M.O.P.No.101 of 2015. For these reasons, she prayed for transfer of H.M.O.P.No.101 of from Gudiwada to Ramachandrapuram.
3. This Court permitted petitioner to take personal notice to respondent through registered post with
acknowledgement due and in compliance of the said order, advocate for petitioner filed memo on 13.04.2016 stating that registered post was duly served on respondent. Along with memo postal acknowledgment is also filed. As seen from the postal acknowledgment notice was received on behalf of respondent on 06.04.2016 and in spite of that neither he appeared in person nor through any advocate.
4. Considering the reasons stated in the affidavit, H.M.O.P.No.101 of 2015 is withdrawn from the file of Senior Civil Judge, Gudiwada, Krishna District, and transferred to Senior Civil Judge, Ramachandrapuram, East Godavari District, for disposal in accordance with law.
5. Accordingly, this transfer C.M.P. is ordered.
6. Miscellaneous petitions pending, if any, shall stand closed.
