THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.36074 of 2018 ORDER:

When the matter is taken up, written instructions, dated 04.10.2018, furnished by the Sub Inspector of Police & SHO, L.Polevaram Police Station, East Godavari District, are placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance to the present Writ Petition, read as under:

"It is submitted that there is a civil dispute between the petitioner and the respondents 5 to 7 herein. Basing on the complaint of the petitioner, a case in Cr.No.166/2018, dt.02.08.2018, u/s 447, 506 r/w 34 IPC, was registered on the file of the 4th respondent police station, against the respondents 5 to 7 herein, wherein after completion of investigation and serving of Section 41-A Cr.P.C. notice to the accused, filed charge sheet o0n 30.08.2018 vide SR.No.1587/2018, and the same is now pending on the file of the Hon'ble AJFCM Courty, Mummidivaram. It is submitted that the respondent police authorities have taken action in accordance with law against the respondents 5 to 7 herein.

It is submitted that the respondent police authorities are not competent or have jurisdiction to interfere in the civil disputes of the petitioner with the respondents 5 to 7 herein and for providing protection to the petitioner in respect of the disputed property, without orders of the competent civil Court, directing the respondent police authorities to provide protection to the petitioner in respect of the property in question".

By placing on record the above written instructions, Writ Petition is closed. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
