HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.15839 of 2014 ORDER:

There is no representation on behalf of the petitioner. The prayer sought in the writ petition is as follows: "... to issue a writ, order or direction more particularly one in the nature of writ of mandamus to declaring the action of 4th respondent in not taking action on petitioner's reports dated 18.11.2013, 06.04.2014 and on 11.05.2014 against the respondents No.5 to 16 herein, who are damaging his agricultural crops which came to yielding and in damaging the electrical agricultural equipment etc, as illegal, arbitrary and also oppose to all cannons of justice as well as abuse of power of police, consequentially direct the 4th respondent to consider his reports dated 18.11.2013, 06.04.2014 and on 11.05.2014 by taking action against the respondents No.5 to 16 herein forthwith by considering the Proceedings in LR No.B/253/2012 dated 19.

02.2013 as well as Proceeding in LR No.B/7484/2012 issued by the Tahasildar, Ibrahimpatan as well as Revenue Division Officer, RR District with regard to the possession of the lands." Learned Government Pleader appearing for respondent Nos.1 to 4 brought to the notice of this Court that pursuant to the complaint lodged by the petitioner, a case in Crime No.174 of 2014 was registered, investigation was completed and final report was filed on 30.11.2015 referring the matter as "false case". In that view of the matter, this Court is of the opinion that the remedy available to the petitioner against filing of the final report is before the concerned Magistrate by way of filing a protest application. Therefore, no further cause would survive in the writ petition.

Accordingly, the writ petition is dismissed. No order as to costs.
