Heard Sri Rajasekhar Rao Tarlada, learned counsel for the petitioner and K. Ramakanth Reddy, learned counsel for the respondents.

The second respondent herein vide SRCAPP 1697 (2012-12) D.EI Ed/Ap/2011-12/36308 dated 24.01.2012 rejected the application of the petitioner herein for permission to D.E.I.Ed Course. As against the said order of rejection, the petitioner herein filed appeal before the first respondent with a delay. By way of an order dated 01.03.2013 the first respondent herein while deciding not to condone the delay in submission of the appeal, decided not to admit the appeal. Aggrieved by the orders of the respondents 1 and 2, the present writ petition is filed.

Sri K.Ramakanth Reddy, learned Standing Counsel for the respondents, submits on instructions that the application of the petitioner was duly considered and by way of an order dated 24.01.2012 the second respondent herein rejected the application of the petitioner and the first respondent herein refused to consider the appeal filed by the petitioner herein on the ground of delay as long back as on 01.03.2013.

Evidently, the petitioner's application was rejected long back and now it is not possible for reviving the application which was already considered and rejected by the NCTE. In addition to that, in view of advent of new NCTE regulations, the application of the petitioner herein cannot be considered under the old regulations. In view of the above, the writ petition is disposed of, permitting the petitioner to make appropriate application to the respondent in terms of new NCTE regulations, 2014 as and when notification is issued by the NCTE and if such an application is made by the petitioner, the same shall be considered and appropriate orders be passed by the respondent in accordance with law. As a sequel, Miscellaneous Petitions, if any, shall stand disposed. No order as to costs.
