THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.15596 of 2014 ORDER:

Surprisingly, the parties herein earlier approached this Court in Crl.P.No.3136 of 2016 requesting to quash the proceedings in SC ST S.C.No.85 of 2015 on the file of Special Judge for SC ST Cases-cum-VI Additional District and Sessions Judge, Kurnool, under Section 482 of Code of Criminal Procedure, 1978, despite the pendency of present petition filed in the year 2014 for the very same relief. Of-course for the same F.I.R., this Court, by an order, dated 14.03.2016, recording a finding that the compromise was arrived at between the parties and further exercise would be nothing but in futility, quashed the proceedings in SC ST S.C.No.85 of 2015, which arises out of the present crime i.e., Crime No.308 of 2014 of Kurnool II Town Police Station, Kurnool District.

The learned Additional Public Prosecutor for the State of Andhra Pradesh, while appraising the above factual narration, placed on record a copy of order, dated 14.03.2016, passed by this Court in Crl.M.P.Nos.3364 and 3365 of 2016 in Crl.P.No.3136 of 2016, and submits that the matter has become infructuous, and therefore, requests to dismiss the present petition. 3.

Perused the order and what all stated by the learned Additional Public Prosecutor is true. In fact, the petitioners, at the time of disposal of aforesaid criminal petition itself, ought to have

reported to the Court about pendency of the present petition, but kept quiet.

Accordingly, the Criminal Petition is dismissed as infructuous. Miscellaneous petitions, if any, pending in this petition shall stand closed.
