The case of the petitioner is that while in service in the respondent department, she availed a sum of Rs.1,25,000/ - towards house loan in the year 1986 as departmental loan by creating mortgage of her property in favour of the President of India, represented by respondent No.1-Government of India through registered mortgage deed No.1390/ 1986, dated: 4.7.1986. 2.

During the period of service, petitioner has cleared the entire loan amount and also officials of the respondents at all levels have recommended directing the Government of India to release the documents which were submitted by her for releasing said mortgage deed stating that there are no out standing dues. Some of the said communication is (1) dated: 23.8.2002 addressed by the Senior Accounts Officer to the Assistant Commandant/ DDO, CISF, NISA, Hyderabad, (2) dated: 22.7.2002 addressed by the Assistant Commandant/ DDO to the Deputy Director General (M), Dtd. General of Health Services Nirman Bhavan, New Delhi, (3) dated: 4.2.2003, dated: 6.11.2003 and dated: 6.9.2004 addressed by the Assistant Commandant/ DDO to the Deputy Director General (M), Dtd. General of Health Services Nirman Bhavan, New Delhi, and (4) dated: 29.1.2009 addressed by the Section Officer, Nirman Bhavan, New Delhi to the Assistant Commandant/ DDO, Hakimpet, Hyderabad. In view of the same, this Writ Petition is allowed directing the respondents to take steps without any further delay for releasing mortgage deed of the petitioner, preferably within a period of eight weeks from the date of receipt of a copy of this Order.
