This petition is filed under Section 482 Cr.P.C., challenging the order dated 12-09-2018 passed in Crl.M.P.No.2534 of 2018 in C.C.No.300 of 2017 by the Additional Judicial Magistrate of First Class, Shadnagar.

However, the petitioner raised several contentions in the petition, learned counsel for the petitioner, during hearing requested the Court to permit the petitioner to file appropriate application and issue a direction to the Magistrate to dispose of the application filed under Section 70(2) Cr.P.C. on the same day.

In view of the request made by learned counsel for the petitioner, the criminal petition is disposed of giving liberty to the petitioner to file application under Section 70(2) Cr.P.C and that the Magistrate is directed to dispose of the application filed under Section 70(2) Cr.P.C. on the same day in accordance with law. With the above direction, the criminal petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
