THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.16745 of 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue Writ of Mandamus declaring the action of the 4th respondent in not correcting the correction in the revised key in respect of one question as illegal, arbitrary and consequently direct the respondents 2 to 4 to consider the representation."
Heard Sri O. Manohar Reddy, learned counsel for the petitioner and learned Government Pleader for Education for respondents.
This Court on 26-06-2015 permitted the petitioner herein to make a representation before the 3rd respondent for redressal of her grievance and further directed the 3rd respondent to consider the same and take appropriate action for referring the matter to the expert's opinion.
In pursuance of the said order, an Expert Committee was constituted. Today, when the matter is taken up, Sri A. Ahishek Reddy, learned counsel for the respondents 2 and 3 has filed an Expert Committee Report counter signed by the Convener, TS EAMCET-2015, wherein it is stated as follows: "The expert committee has gone through this question and referred various standard text books including Academi Books. The committee has noticed that Option (4) was declared as the correct choice in the Preliminary Key. Later in the final key based on the objections received Option (1) was
finalized as the correct choice. Accordingly, the marks were declared to all the candidates.
Based on the representation received and after going through the standard books, the committee decided that Option (4) only is the correct choice."
While referring to the same learned counsel for the petitioner requested this Court to issue necessary directions to the respondents to take appropriate action in terms of the above mentioned.
For the aforesaid reasons, the writ petition is disposed of directing the respondents herein to take appropriate action, in accordance with the procedure, pursuant to the above mentioned report submitted by the Expert Committee pursuant to the orders of this Court, dated 26-06-2015. There shall be no order as to costs.
The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
