THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.1322 of 2016 ORDER:

This Contempt Case is filed alleging non-implementation of the order in W.P.No.26900/2011 dated 03.11.2011. The petitioner filed the said writ petition challenging the action of respondents in not taking any action based on the representations to prevent the encroachers in securing the parking area. This Court disposed of the writ petition by recording that the respondents have taken appropriate action in erecting the sign boards stating that the land belongs to the Municipal Corporation and no person encroached into the property on that day. After five years, the petitioner came up with this Contempt Case alleging violation of the order, when there was no direction in a positive manner in favour of the petitioner.

In the circumstances, this Court sees no ground to entertain the present Contempt Case and accordingly, this Contempt Case is dismissed. No order as to costs. However, it is open to the petitioner to take appropriate legal proceedings, if any fresh cause of action arises after disposal of the earlier writ petition.

Miscellaneous Petitions pending, if any, shall stand closed.
