HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.36054 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 3rd respondent in issuing the impugned endorsement in Rc.B 684/2017, dated 13.12.2017, informing that the request for mutation of the name of the petitioner in respect of land admeasuring Ac.4.28 cents situated at Sy.No.315 of Pasupula Village, Kurnool Mandal and District having been succeeded the same from his father, cannot be considered as the same is sub judice before the Principal Senior Civil Judge, Kurnool in O.S.No.251 of 2010, though the petitioner is not a party to the same, as illegal and arbitrary.

The grievance of the petitioner appears to be that the request of the petitioner for mutation of his name in the revenue records came to be rejected on the ground the matter is seized by the civil Court in O.S.No.251 of 2010, on the file of Principal Senior Civil Judge, Kurnool. A perusal of the record discloses that the above said suit was dismissed in the month April, 2018 and the impugned rejection order came to be passed in the month of December, 2017. If that being the position, one cannot find fault with the impugned order passed by the Tahsildar. Hence, the petitioner can make a fresh application through online seeking mutation of his name in the revenue records enclosing the necessary documents in respect of the subject land.

months from the date of submission of the application, by giving reasonable opportunity of hearing to the petitioner and all concerned. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
