THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO.39591 OF 2014 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader appearing for respondent Nos. 1 and 2. 2.

The prayer sought in the Writ Petition is as under: " ....to issue an order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd Respondent in interfering with Civil Disputes pending Appeal Suit before the Hon'ble IV Additional District Judge, Tanuku, West Godavari District with the instance of the Respondent No. 3 and 4 and consequently direct the respondents not to interfere with peaceful possession of the petitioner property."

During the course of arguments, learned GP submitted written instructions dated 30.12.2014 issued by the Assistant Sub-Inspector of Police, Penugonda P.S., West Godavari district. 4.

From a perusal of the said written instructions, it is revealed that respondent No.4 herein lodged a complaint on 4.12.2014 leading to registration of a case in Crime No.195 of 2014 under Sections 447, 384 read with 34 IPC.

The investigating Officer took up investigation and examined some witnesses. During the course of investigation, Accused Nos. 1 and 2 obtained bail. After investigation, charge sheet was filed on 26.12.2014 and CC number is awaited. The petitioner was not found guilty as no c ase was made out against him. It is also stated in the written instructions that they are not interfering in the civil disputes between the petitioner and others.

The written instructions are made part of the record.

In the light of the above, this Court is of the opinion that no further orders are required in the Writ Petition. 8.

Accordingly, the Writ Petition is closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
