THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.25574 OF 2012 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to declare the action of respondent Nos.1 to 3 in not demolishing the illegal constructions made by respondent Nos.4 to 6 over the schedule property i.e., MIG Block No.12 i.e., 12/2, 12/4 and 12/6 (from JNTU to Hi-tech City Road, opposite to Kalanjali), Phase III, KPHB Colony, Kukatpally, Ranga Reddy District as illegal and arbitrary and consequently, direct respondent Nos.1 to 3 to demolish the illegal constructions over the said schedule property.

The main grievance of the petitioners is that respondent Nos.1 to 3 are not demolishing the illegal constructions made by respondent Nos.4 to 6 over the aforementioned schedule property and hence, prays to direct respondent Nos.1 to 3 to demolish the illegal constructions made by respondent Nos.4 to 6 over the said property.

When the matter is posted for hearing, Smt Pingali Laxmi, learned Standing Counsel appearing for the respondent Corporation, produced the action taken report of respondent No.2 - The Deputy Commissioner, Kukatpally, Ranga Reddy District and informed that already, the unauthorised constructions made by respondent Nos.4 to 6 were demolished and if any further constructions are made unauthorisedly by respondent Nos.4 to 6, the same would be removed in accordance with law.

Recording the said submission of the learned Standing Counsel, the Writ Petition is disposed of. There shall be no order as to costs.

The action taken report of respondent No.2 shall form part of the record.

6.

Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
