THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.2299 OF 2013 ORDER:

This writ petition was filed challenging the inaction of the third respondent in canceling the pattadar pass books issued in favour of Manubotu Shankaramma and Manubotu Krishnaiah in respect of land admeasuring Acs.2.89 cents in Survey No.20 of Garimenapenta Village, Raipur Mandal, SPSR Nellore District, even after passing a declaratory decree by the learned Junior Civil Judge, Venkatagiri, in O.S.No.65 of 2010, dated 25.06.2010.

This Court while taking up the matter on 29.01.2013 directed the petitioner to file an application to implead the affected parties, but no such application is filed till today.

In the circumstances, the writ petition is dismissed giving liberty to the petitioner to take appropriate proceedings in accordance with law, more particularly, as per the provisions of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971, for redressal of his grievance.

The writ petition is accordingly dismissed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs.
