THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.3191 of 2016 ORDER:
Heard learned counsel for the petitioner/A.21 and the learned Public Prosecutor.
2. The petitioner/A.21 filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with Crime No.01 of 2016 of I Town Police Station, Nalgonda, registered for the offences punishable under Sections 370 (1) (2) and (3) and 420 read with 120 (B) IPC and Sections 18 and 19 of the Andhra Pradesh Transplantation of Human Organs Act, 1995 and Section 8 of the Criminal Law (Amendment) Act, 2013.
3. At the time when the matter is taken up for hearing, it is brought to the notice of this Court that earlier the petitioner herein filed bail application and the same was rejected while giving a direction to provide medical treatment to the petitioner. Learned counsel for the petitioner submitted that till date no proper medical treatment is provided and condition of the petitioner is very critical. It is also urged that other accused are released on bail.
4. Though learned counsel for the petitioner stated that the condition of the petitioner is serious, no document is filed to prove the same.
5. In view of the above, the Criminal Petition is disposed of giving liberty to the petitioner/A.21 to move the bail petition before the Court concerned and in which event the same shall be dealt with in accordance with law.
