ORDER:

This Contempt Case is filed alleging willful disobedience of order, dated 17.12.2013, in Writ Petition No.36961 of 2013.

The petitioners herein have filed Writ Petition No.36961 of 2013 for a Mandamus to declare the inaction of the respondents in granting NOC to them in

respect of an assigned land. This Court by order, dated 17.12.2013, disposed of the said Writ Petition with a direction to the respondent herein to consider petitioner No.1's representation and take a decision by examining whether the assignee through whom the petitioners claim interest over the assigned land falls within the category of Ex-service men and whether the petitioners are entitled to grant of NOC for sale of the said land. Alleging that the said order has not been complied with, the petitioners have filed this Contempt Case. At the hearing, learned Government Pleader for Revenue (Andhra Pradesh) placed before the Court endorsement in Rc.No.5187/2013/E.1, dated 19.12.2014, of the respondent, wherein he has held that the petitioners are not entitled to grant of NOC as G.O.Ms.No.307 Revenue (Assignments-I) Department, dated 06.

06.2013, is not applicable to the present case. Though the respondent failed to adhere to the time limit stipulated by this Court in considering the representation of petitioner No.1, in view of the fact that the decision has been taken by him immediately after the filing of the Contempt Case, I am not inclined to proceed with the contempt any further.

Accordingly, the Contempt Case is closed with liberty to the petitioners to avail appropriate remedy if they feel aggrieved by the above-mentioned endorsement issued by the respondent.
