THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.5190 of 2016 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. seeking to direct the XXV Special Metropolitan Magistrate, Hyderabad to send Ex.P1-cheque and Ex.P8-promissory note in C.C.No.243 of 2015 along with the certificate issued by the Branch Manager, SBI, Kukatpally, Hyderabad, containing the admitted signature of the petitioner/accused for comparison of signatures to the FSL, Hyderabad.
Heard and perused the material available on record. The Crl.M.P.No.3734 of 2015 in C.C.No.243 of 2015 filed by the petitioner seeking to send Ex.P1-cheque and Ex.P8promissory note to the handwriting expert, Government Forensic Laboratory, to examine the same, was dismissed by the XXV Special Magistrate at Hyderabad on 11-01-2016 and subsequently the Criminal Revision Petition No.15 of 2016 in C.C.No.243 of 2015 was dismissed on 12-02-2016 by the Additional Metropolitan Sessions Judge for the trial of Jubilee Hills Car Bomb Blast Case-cum-Additional Family Court-cum-IX Additional Metropolitan Sessions Judge, Hyderabad. The trial court as well as the first appellate court categorically discussed the points raised by the petitioner for sending the documents for handwriting expert. The trial Judge as well as the lower appellate judge also considered
extensively regarding the reply notice given by the accused on receipt of the statutory notice in which he admits the signatures in the promissory note as well as the cheque and passed the orders.
In view of the concurrent finding, that too on merits, this Court is not inclined to interfere with the order impugned. Accordingly, the Criminal Petition is dismissed.
Consequently, Miscellaneous Petitions pending, if any, in the Criminal Petition shall stand closed.
