HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.41776 of 2016 ORDER:

When the matter is taken up for hearing, counsel for the petitioner as well as learned Government Pleader appearing for the respondents submitted that the issue raised in this writ petition is squarely covered by the judgments of the Hon'ble Supreme Court in District Collector/ Chairman and Others Vs.

M.L.Singh and Others1 and B.Srinivasulu vs. Nellore Municipal Corporation in Civil Appeal No.6318 of 2015 (arising out of SLP(C) No.12432/ 2014) dt.17.08.2015 and contended that the present writ petition be disposed of in terms of the above said judgments.

In view of the above submissions and for the reasons alike in the aforesaid judgments of the Hon'ble Supreme Court, this writ petition is disposed of directing the respondents to regularize the services of the petitioner on the basis of Notification issued in G.O.Ms.No.212 dated 22.04.1994 with effect from the date the petitioner completed five years' continuous service. It is however made clear that the other conditions laid down in the said G.O.Ms.No.212 will have to be satisfied for the purpose of regularisation. There shall be no order as to costs.
