ORDER

Heard learned counsel appearing for petitioner and learned Standing Counsel appearing for respondentUniversity.

This writ petition is filed seeking to declare the action of the respondent in non-payment of wages for the period from May to January, and not considering the case of the petitioner for appointment in the respondent-University as arbitrary and illegal.

The case of the petitioner is that he worked as Carpenter in the respondentUniversity in the department of Institute for Costal and Offshore Research (INCOR) and put in service of seven years.

Thereafter, his services were discontinued.

Hence, he filed W.P.No.2024 of 1989 and the same was disposed of by directing the respondents to consider the case of the petitioner for appointment in a suitable post. The writ appeal preferred against the said order was dismissed. The petitioner

further states that he filed W.P.No.27618 of along with others seeking regularization of services from the date of initial appointment as per the scheme framed pursuant to judgment in W.P.No.2024 of 1989 as upheld in Civil Appeal and for payment of arrears of salary. The said writ petition was disposed of on 15.12.2008, permitting petitioners to file petitions claiming wages within a period of four weeks from that date. Pursuant to the same, the petitioner submitted representation on 9.1.2009 for payment of salaries for the period from May 1993 to January, 1995. When the same was not considered, the present writ petition was filed.

In the present writ petition, there is no explanation for the delay of seven years in approaching this Court. The affidavit filed in support of the petition is also bereft of proper facts. However, it is left to the respondent-University to consider representation of petitioner dated 9.1.2009 in terms of the judgment in W.P.27618 of 1997, dated 15.12.2008 and dispose of the same within a period of six

months from the date of receipt of a copy of this order.

Accordingly, Writ Petition is disposed of. No costs.

Miscellaneous petitions, if any, pending shall stand closed.
