THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.27403 of 2014 ORDER:

Heard learned counsel for the petitioner as well as learned Government Pleader appearing for the respondents 1 to 4. 2.

The prayer sought in the writ petition is as under:- "...to issue Writ Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of 5th Respondent in harassing the petitioner and his family members in relation to the civil dispute between the petitioner and the 6th Respondent as illegal, arbitrary and unconstitutional and consequently direct the 5th Respondent not to harass the petitioner and his family members and pass such other relief as this Hon'ble Court deems fit and proper in the circumstances of the case."

The 3rd respondent filed a counter-affidavit denying the allegations made in the affidavit filed in support of the writ petition and contended inter alia that the respondent police never harassed, threatened and interfered with the civil disputes between the petitioner and the 6th respondent with regard to borrowing of Rs.50,000/- and calling the petitioner to the Police Station at any point of time, apart from other aspects.

In spite of specific averments made in the counter-affidavit, the petitioner has not filed any reply affidavit rebutting the contentions raised in the counter-affidavit. Therefore, the contents in the counteraffidavit goes un-rebutted and binding on the petitioner.

In that view of the matter, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be closed. 6.
