THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10461 OF 2013 ORDER:

This petition is filed for a writ of Mandamus declaring the seizure of petitioner's Unani Clinic M.S.Clinic, located at H.No.135-4, Beside Tappa Chabutra Police Station, Hyderabad, by the respondent through proceedings dated 08.03.2013 under the Andhra Pradesh Allopathic Private Medical Care Establishments (Registration & Regulation) Act, 2002, as illegal and arbitrary and consequently to set aside the proceedings dated 08.03.2013 by permitting the petitioner to run the clinic.

This Court while admitting the writ petition on 09.04.2013 granted interim suspension of the impugned proceedings dated 08.03.2013 and also directed the petitioner to cooperate with the Inspecting Officials whenever inspection of the clinic is made. Though, this Court passed interim order on 09.04.2013, till today, no counter is filed by the respondent. Since this Court suspended the seizure proceedings issued by the respondent on 08.04.2013, the petitioner reopened the clinic and running the same and the interim order is in operation from the year 2013 onwards. The relief sought in the writ petition is worked out by virtue of interim order dated 08.03.2013, as such, I deem it appropriate to dispose of the writ petition in terms of the interim order dated 09.04.2013, passed by this Court in WP.MP.No.12980 of 2013.

Accordingly, the writ petition is disposed of. However, this will not preclude the competent authority from taking appropriate

action in accordance with law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending, in the writ petition, shall stand closed.
