M/S. Kaaba Hospital, v. The Government Of Andhra Pradesh
HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.18953 of 2012 Order:
The petitioner has been running a hospital by name Kaaba Hospital. The said hospital is located in his own premises. His vendor was also running a hospital before selling the property to the petitioner. When the officials of the second respondent came to the hospital and when the third respondent issued a notice on 20.06.2012 pointing out certain discrepancies and asking to rectify the same within seven (7) days and also asking the petitioner to close the hospital meanwhile, the petitioner approached this Court.
This Court, by order dated 25.06.2012, directed the respondents not to insist for closure of the hospital of the petitioner and the said order has been in operation till today.
Though the learned counsel for the petitioner submitted that the second respondent has no jurisdiction to issue the impugned notice, since the discrepancies were pointed out by the third respondent who is acting on behalf of the second respondent, liberty is given to the petitioner to submit a representation to the respondents 2 and 3 within a period of fifteen (15) days from the date of receipt of a copy of this order and it is open to the respondents to pass appropriate orders in accordance with law after hearing the petitioner. Till such time, no action shall be taken for closure of the hospital of the petitioner. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
ARLR, J WP No.18953 of 2012 As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
