THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.29262 OF 2013 ORDER:

The prayer sought for in this writ petition is as under: "to Issue an order direction or Writ more particularly in the nature Writ of Mandamus by declaring the inaction of the 5th respondent in conducting investigation in a fair and proper manner as per the mandate of the Criminal Procedure Code like apprehending the accused till date and inaction of the respondent No. 3 in allowing the transfer of the investigation to the 2nd respondent and the action of 4th respondent on 1-10-2013 without jurisdiction as arbitrary and illegal mala fide and with ulterior motive and without jurisdiction after calling for the records upto date relating to the FIR No.

6 of 2013 on the file of the II Town Police Station, Chittoor and consequently direct the 2nd respondent to take up the investigation of the said case on being transferred of the same from the 5th respondent in the interest of justice and to act as per the procedure prescribed under the Criminal Procedure Code." Sri Ramesh Babu, the learned Assistant Government Pleader for Home (A.P.) submits that even before filing of the writ petition, investigation into the above crime was completed and final report was also filed.

In that view of the matter, nothing survives for adjudication in the writ petition and the same is accordingly dismissed. No costs.
