THE HON'BLE SRI JUSTICE A.V. SESHA SAI Writ Petition No. 12836 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue Writ or direction preferably Writ of Mandamus, declaring the action of the respondent Nos.3 and 4 in not providing police protection to the petitioner despite interim injunction orders granted in I.A.No.390/2014 in OS.No.100 of 2014 dated 1-8-2014 on the file of learned Junior Civil Judge, Darsi, Prakasam District, despite representations dt.17-4-20115 as illegal, arbitrary and violative of principles of natural justice and consequently direct the respondent Nos.2 to 4 to provide police protection to the petitioner, and pass such other or further orders as this Hon'ble Court deems fit and proper in the circumstances of the case."

Heard the learned counsel for the petitioner and learned counsel for the respondents.

This Court on 28-04-2015 issued directions to the 4th respondent herein to examine the petitioner's request dated 17-04-2015, in the light of the orders of temporary injunction granted in his favour by the learned Junior Civil Judge, Darsi in O.S.No.100 of 2014 and take appropriate action. Today, when the matter is called, the learned Government Pleader for Home placed before this Court, a copy of the written instruction submitted by the Station House Officer, Thalluru Police Station, Prakasam District, dated 30-04-2015. It is stated in the said instructions that the petitioner's land is under dispute before the Civil Court, and it was suggested to him

to obtain police aid order from the Civil Court. It is further stated therein that as per the age of the petitioner, the respondents-police deputed one police constable to the petitioner's residence for recording his statement, and that they will take steps to provide police protection as per law. On noticing the same, the learned counsel for the petitioner submits that the writ petition may be disposed of, in terms of the written instructions submitted by the 4th respondent.

In view of the above reasons, the writ petition is disposed of by recording the instructions furnished by the Station House Officer, Thalluru Police Station, Prakasam District, dated 30-04-2015.

The miscellaneous petitions, if any, filed in the writ petition shall also stand disposed of. There shall be no order as to costs. _________________ A.V. SESHA SAI, J.
