HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT AAPPEAL No. 242 of 2016 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

This writ appeal is directed against the order, dated 18.03.2016, passed in W.P.No.6647 of 2016, which reads as follows: "Whether there is a permission of the Gram Panchayat or not is required to be stated by the Gram Panchayat by filing a counter. Time granted for filing a counter by the respondents. Prima facie in the present day of communications establishing a cell tower cannot be interdicted on the mere allegations of the petitioners. Erection of the cell towers shall be subject to the result of the writ petition.

Post after two weeks."

Sri G. Narender Reddy, learned counsel for respondent No.8, submits that Gram Panchayat has issued No Objection Certificate for erecting telecommunication tower and that it will take decision whether to grant approval for the questioned telecommunication tower within a period of two weeks from today.

In view thereof, we are not entertaining this appeal. Respondent No.8 is directed to file their counter affidavit within a period of two weeks from today placing the decision of the Gram Panchayat on record. Thereafter, it is open to the appellants to move learned Single Judge for expeditious hearing of the writ petition. With the above observation, writ appeal is disposed of. Miscellaneous petitions, if any, shall also stand disposed of.
