M.A. Hannan v. The State Of Telangana
HON'BLE SRI JUSTICE C.PRAVEEN KUMAR W.P. No. 36247 of 2018 ORDER:
The present writ petition came to be filed seeking the following relief:
" to declare the action of the respondents in not passing interim orders in the revision filed by the petitioner against the orders passed by the Revenue Divisional Officer, vide proceedings No.B/ 1037/ 2017, dated 02.07.2018 on 11.09.2018 as illegal, arbitrary, in violation of Articles 14, 21 and 300-A of the Constitution of India, besides in violation of principles of natural justice and also in violation of APLE Act and consequently direct the respondents not to interfere with the peaceful possession and enjoyment by the petitioner of the subject property bearing H.No.
8-2-603/ B/ 34/ 22, admeasuring 278 sq.yards, situated at Singada Basti, Gowri Shankar Nagar, Banjara Hills, Hyderabad till the disposal of the revision petition filed by the petitioner on 11.09.2018 against the orders passed by the Revenue Divisional Officer vide N;.B1/ 1037/ 2017 dated 02.07.2018."
2.
As seen from the record, the petitioner herein filed a revision before the Government of Telangana, Secretariat, Hyderabad on 11.09.2018, questioning the orders passed by the Revenue Divisional Officer in the month of July, 2017. Along with the revision, the petitioner claims to have filed a stay application. The grievance of the petitioner appears to be that the authorities
have not taken any steps either to number the revision or take up the stay application.
3.
Insofar as the stay application filed by the petitioner, along with the revision is concerned, Government Pleader would submit that the same came to be dismissed, and that the petitioner is not in possession of the subject property. At this stage, the counsel for the petitioner would submit that the order passed by this court in W.P.No. 13056 of 2017 would amply establish that the petitioner is in possession of the subject property, pending disposal of the revision.
4.
Having regard to the above, status quo as on today, in all respects, to be maintained, for a period of eight weeks from the date of receipt of this order, within which time, the stay application filed by the petitioner, along with the revision, shall be disposed of by the respondents, by passing orders thereon, in accordance with law.
5.
In view of the above, the writ petition is disposed of at the admission stage. Miscellaneous Petitions, if any, pending in this writ petition, shall stand closed.
