HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.29341 of 2015 ORDER:

Heard.

The petitioners herein are aggrieved by the proceedings of the 5th respondent in Lr.No.C/1455/2007, dated 22-05-2015 and the learned counsel for the petitioners states that the petitioners have already submitted application, dated 19-05-2015 to the Hon'ble Chief Minister, State of Telangana, Principal Secretary, Scheduled Caste Department, the Collector, Ranga Reddy District etc., seeking to assign the land and the same is still pending.

A look at the proceedings of the 5th respondents, referred to above, would show that it is only a report sent by the 5th respondent to the 3rd respondent and it cannot be appreciated as to how a report can be subject matter of judicial review, as the District Collector is entitled to call for a report from any subordinate officer before taking any decision in the matter. It cannot, therefore, be said that the rights of the petitioners are infringed by the said report. Hence, to that extent, no relief can be granted to the petitioners. However, to the extent of request of the petitioners for assignment, the same already appears to be under consideration by the competent authority. The writ petition is, therefore, disposed of directing respondents 2 and 3 to consider the aforesaid representation of the petitioners in accordance with law and the Policy of the State and pass appropriate orders expeditiously. No costs.

Miscellaneous petitions, if any, pending shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date: 11-09-2015 Prv HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR
