THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.8761 of 2016 ORDER:

This Writ Petition is filed for a Mandamus to declare the action of the first respondent in not receiving the petitioner's application for correction of date of birth in his passport as 02.02.1996 in the place of 02.02.1992 as illegal and arbitrary. Heard the learned Counsel for the petitioner and learned Standing Counsel for Central Government.

In similar circumstances, this Court disposed of W.P.No.8094 of 2005 dated 12.12.2005, wherein the Passport Issuing Authority was directed to consider the application of the petitioner therein in the light of the instructions in circular dated 18.04.2001.

Since the Government issued circulars for correction of date of birth, and following the order of this Court in W.P.No.8094 of 2005 dated 12.12.2005, the respondents are directed to consider the petitioner's application for issuance of fresh passport with correct date of birth within a period of four weeks from the date of receipt of a copy of this order.

Subject to the above direction, the Writ Petition is disposed of.

Miscellaneous petitions pending, if any, shall also stand disposed of. However, in the circumstances, without costs. A.RAJASHEKER REDDY, J Date:27.06.2016 usd
