HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.29424 OF 2016 ORDER:

This writ petition is filed declaring the action of the 2nd respondent in including the property of the petitioners admeasuring nearly Ac.5.53 cents in Sy.No.644/2 of P.Rudraram Village, Kurnool Mandal and District in the list of prohibited properties communicated vide dated 17.01.2012 in R.Dis.(E2)/2845/2010, as illegal and arbitrary.

Heard the learned counsel for the petitioners. Learned Assistant Government Pleader for Revenue produced written instructions dated 02.09.2016 addressed by the 6th respondent wherein it is clearly stated that the said land i.e., Ac.5.53 cents in Sy.No.644/2 was excluded from the New list of Prohibited properties and the same was converted from Agriculture to Non-Agriculture vide land conversion proceedings dated 25.08.2012 issued by the Revenue Divisional Officer, Kurnool. It is further stated that the subject land was erroneously included in Prohibited list of properties treating it as Assigned land during the year 2007.

In view of the above facts and circumstances, the writ petition is allowed. No costs.
