THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.6020 of 2016 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/ accused in Crime No.19 of 2016 of Nadigudem Police Station, Nalgonda District registered for the offences punishable under Sections 406 and 420 IPC.
Heard and perused the material on record.
The main grievance of the petitioner/accused is that the petitioner/accused was arrested on 17-02-2016 in connection with Crime No.30 of 2016 of Kodad Town Police Station and was detained in prison for a period of two weeks. It is the further case of the petitioner is that the present crime was registered on 14-022016 prior to his arrest on17-02-2016 even though he was detained in prison and that even though P.T. warrant was issued to produce him, he was not remanded to judicial custody and that now the police are trying to arrest him in connection with the present crime.
It is evident from the material on record that the petitioner/ accused was involved in various cases for which P.T. warrants were pending execution for producing him in such cases. Having regard to the facts and circumstances of the case and considering the submissions of the learned counsel for the petitioner and taking into consideration the pendency of P.T. warrants against the petitioner/accused, this Court is of the view that ends of justice would be met if the petitioner/accused can be
directed with appropriate directions.
Therefore, the petitioner/accused is directed to surrender before the respondent police on or before 07-06-2016 and execute a bond for Rs.10,000/- (Rupees ten thousand only) with one surety for his future appearance and on such execution, the respondent police are directed to complete investigation without arresting the petitioner/accused and file final report, if any, in accordance with law.
Accordingly, the Criminal Petition is disposed of.
Consequently, miscellaneous petitions, if any, pending shall stand closed.
