COMMON ORDER Since the issue involved in all the criminal petitions is one and the same, these criminal petitions were heard together and are being disposed of by this common order.

These Criminal Petitions are filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') seeking to enlarge the petitioners on bail, who are arrayed as accused Nos.4 and 5 in Crime No.99 of 2025 before the INSP ADMIN (DD) Police Station, Hyderabad. 3.
The brief facts of the case are that, basing on the complaints lodged by de-facto complainants alleging irregularities and fraudulent practices committed by Universal Srushti Fertility & Research Centre, Secunderabad, and its staff in connection with a surrogacy procedure, the Gopalapuram Police registered a case in Crime Nos.157, 154, 152 and 156 of 2025. The cases were subsequently transferred to CCS, DD, Hyderabad, wherein it was re-registered as Crime No.101, 95, 99 and 102 of 2025.

Heard Sri Y. Soma Srinath Reddy, learned counsel appearing on behalf of the petitioners as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioners submitted that the petitioners are innocent of the alleged crime, have been falsely implicated in the case, and that there is no cogent or direct evidence against them to support the allegations. He further contended that Section 111 of the BNS is not applicable to the present case, as the petitioners have not been involved in any other criminal activity. He also submitted that Accused No.2 was granted bail vide common order dated 17.11.2025 and prayed for parity on the same footing. Hence, he requested this Court to grant regular bail to the petitioners. 6.
On the other hand, learned Additional Public Prosecutor submitted that the allegations against the petitioners are heinous in nature and that the investigation is still in progress. Therefore, he prayed the Court to dismiss the criminal petitions. 7.
In the light of the submissions made by both the learned counsel and on perusal of the material available on record, it is
observed that the petitioners have been in judicial custody since 27.07.2025, and the PT warrant was regularized on 15.09.2025. This Court had already directed the investigating officer on 11.11.2025 to follow the procedure contemplated under Section 35(3) of the BNSS, while observing that Section 111 of the BNS is not applicable to the petitioners. It is further noted that Accused No. 2 has already been granted bail. Considering all these circumstances, this Court deems it fit to grant bail to the petitioners, subject to the following conditions: i.
The petitioners-accused Nos.4 and 5 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each in each crime to the satisfaction of XII Additional Chief Metropolitan Magistrate, Hyderabad.
ii.
The petitioners-accused Nos.4 and 5 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.
iii.
The petitioners- accused Nos.4 and 5 shall abide by the conditions stipulated in Section 483(2) of BNSS.

Accordingly, all the Criminal Petitions are allowed. Miscellaneous applications, if any pending, shall also stand closed.
