HON'BLE SRI JUSTICE SURESH KUMAR KAIT W.P. No. 24289 of 2016 DATE: 22.07.2016 Between:

Smt. Kursheed Iqbal Begum .. Petitioner And The State of Telangana and two others .. Respondents

O R D E R:- This writ petition is filed for the following substantive relief:

"..... to issue a writ, order or direction more particularly one in the nature of writ of mandamus, declaring the action of the 3rd respondent in demanding the petitioner to handover 100 square yards from her property bearing Municipal No.6-4-47, situated at Bholakpur, Secunderabad located from Musheerabad Junction to Boats Club via. Kavadiguda Junction for the purpose of road widening without initiating land acquisition proceedings and without paying any compensation, as illegal, arbitrary and violative of principles of natural justice and consequently direct respondent Nos.2 and 3 to follow due process of law if portion of the property in question is required for road widening."

Sri Chatla Madhu, learned Standing Counsel for Greater Hyderabad Municipal Corporation appearing for respondent Nos.2 and 3 has fairly conceded that they will not dispossess the petitioner from the property in question without following the due process of law.

Keeping in view the averments made in the writ affidavit and the submission of the learned Standing Counsel, I deem it appropriate to dispose of the writ petition with the following direction:

"RespondentNos.2 and 3 are directed not to dispossess the petitioner from the property in question without following the due

process of law."

Subject to the above direction, the writ petition is disposed of. No order as to costs.

As a sequel to the disposal of the writ petition, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
