Bhanu Prasad for petitioner and Mr. Cheemalapati Ravi for third respondent.

The grievance of petitioner is that an order is communicated in the form of notice by recording a conclusive finding against the petitioner. According to him, the petitioner has valid explanation and opportunity ought to have been given to petitioner. 3.

Counsel for third respondent submits that the communication impugned in the writ petition can be treated as show cause notice, two weeks time from today can be given to petitioner for submitting explanation/ reply, if any and thereafter, the third respondent will consider the issue and pass a speaking order. 4.

The statement is placed on record. The writ petition is disposed of by this order:

a) The communication impugned in the writ petition shall be treated as show cause notice.

b) Petitioner is given two (2) weeks time from today to submit explanation/ reply.

c) The third respondent is directed to consider the issue and pass order within a further period of four (4) weeks thereafter.

d) Till the exercise, as directed by this Court, is completed, the demolition threatened through impugned communication shall be stayed.
