THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 17729 of 2016 ORDER:

Heard learned counsel for the petitioner, Sri Pasham Krishna Reddy, learned Standing Counsel and learned Government Pleader for Municipal Administration.

The present Writ Petition is filed with the following prayer: 'For the reasons stated in the accompanying affidavit, the petitioner herein prays that the Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of respondents in trying to take the petitioner's land at H.No.8-15-127/1 and 127/2, L.B.Nagar, Hyderabad in an extent of 71.19 square yards as illegal, null, void and arbitrary and consequently direct the respondent to take the land equally on both sides of the road for the multilevel flyovers for which the petitioner is ready and willing to hand over 1.5 meters all through in front of his theatre premises and to pass such other order or orders as the Hon'ble Court may deem fit and proper in the circumstances of the case.'

It is represented by the learned counsel for the petitioner that though he is willing to hand over 1.5 meters in his theatre premises, still the authorities are insisting for 2.26 meters, by virtue of which, he would be losing a portion of his existing theatre. He submits that if the land is taken from either side of the road, no prejudice would be caused to any of the parties.

Having regard to the circumstances stated above, the petitioner shall make a request to the second respondent through third respondent, within one week from today, in which event the second respondent shall pass appropriate orders within two weeks
