THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.15002 of 2013 ORDER:

This petition is filed by A.3 under Section 482 of Cr.P.C. to quash the proceedings in PRC No.48 of 2009 pending on the file of Judicial First Class Magistrate, Narayanpet, Mahabubnagar District registered for the offences punishable under Sections 306, 506 and 189 IPC. The deceased was working as Agriculture Officer of Devarakandra Mandal. In a scheme formulated by the Government, the said Mandal was allotted 35 sprinklers to be allotted exclusively for poor and marginal farmers of the Mandal. It is alleged that A.1 to A.3 gave certain names and pressurized the deceased to include the names of their candidates in the final list. On 14.10.2009 unable to bear the said pressure, the deceased committed suicide by setting her ablaze. Heard and perused the material available on record. In an earlier occasion, A.1 and A.

2 approached this Court to quash the proceedings against them and this Court by common order dated 8.10.2013 allowed Crl.P.Nos.274 and 1272 of 2010 quashing the impugned proceedings as against them. The petitioner herein who is A.3 is also on the same footing as that of A.1 and A.2. Further a reading of the dying declaration given by the deceased does not disclose any inducement that necessitated her to commit suicide. Even admitting the entire allegations made in the dying declaration are to be true, no case is made out against the petitioner for the alleged offences.

against the petitioner herein is abuse of process of law and liable to be quashed.

In the result, the Criminal Petition is allowed and the impugned proceedings in P.R.C.No.48 of 2009 pending on the file of Judicial First Class Magistrate, Narayanpet, Mahabubnagar District are hereby quashed as against the petitioner herein.
