ORDER

The present criminal petition is filed seeking to quash the docket order dated 18.04.2016 passed in Crl.M.P.No.910 of 2016 in C.C.No.301 of 2013 on the file of Judicial First Class Magistrate, Narayanpet.

2. Heard and perused the material on record.

3. The petitioners/A3 to A6 are involved in C.C.No.301 of 2013 on the file of Judicial First Class Magistrate, Narayanpet, registered for the offences punishable under Sections 406, 495, 420, 324, 506, 509 r/w 34 IPC. Since NBWs are pending against the petitioners, they filed the impugned application under Section 317 Cr.P.C. seeking to dispense with their personal attendance before the trial Court. By the order impugned, the said application was dismissed. Challenging the same, the present criminal petition is filed.

4. Issuance of NBW is to secure the attendance of the petitioners before the trial Court.

As the petitioners expressed their willingness to appear before the trial Court regularly, the NBWs issued against them can be recalled.

5. The Criminal Petition is disposed of, with the following direction;

The petitioners/A3 to A6 are directed to surrender before the trial Court on or before 15.06.2016 and make an application for recalling of NBWs pending against them. On filing such an application, the trial Court shall recall the warrant on the petitioners executing a bond for a sum of

Rs.5,000/- (Rupees five thousand only) each with one surety for a like sum each to its satisfaction, failing which, the trial Court is at liberty to take appropriate steps. Till such time, the warrants issued against the petitioners are hereby suspended. The petitioners herein are further directed to appear before the trial Court on each and every date of adjournment.

Miscellaneous Petitions, if any, pending in this petition shall stand closed.
