HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.18184 of 2015 ORDER:

Heard Sri Peeta Raman, learned counsel appearing for the petitioner and Sri Resu Mahender Reddy, learned standing counsel for respondents 1 and 2.

2. The petitioner is working as Junior Accounts Officer in the 2nd respondent office. He is having some disputes with his wife. According to him, he was transferred from previous station about three years ago. In the previous station, he was allotted staff quarter, which is now being used by his wife and children. He filed the present writ petition seeking a direction to respondents 1 and 2 to initiate action to vacate petitioner's wife and children from the said quarter on the ground that he has not been paying house rent allowance in the present station on account of occupation of the said quarter by his wife and children.

3. As per law, the petitioner is bound to provide residence to his wife and children, if they are staying away from him. The jurisdiction of this court under Article 226 of the Constitution cannot be exercised to settle personal disputes between the petitioner and his wife.

4. The writ petition is accordingly dismissed at the stage of admission. Miscellaneous applications, if any, shall stand closed. No order as to costs.
